By utilizing BeFi Tools during the entry period, You, the Entrant, have affirmatively reviewed, accepted, and agreed to all of the Terms and Conditions of the Sweepstakes set forth herein.

The BeFi Tools Sweepstakes (the “Sweepstakes”) is operated and sponsored by Orion Advisor Solutions, Inc., 17605 Wright Street, Omaha, NE 68130 (“Orion”). Orion will conduct the Sweepstakes as described in the terms and conditions (the “Terms and Conditions”) set forth below.

 

Terms & Conditions

1. Eligibility. The Sweepstakes are open to legal residents of the United States of America. Entrants (later defined) must be 18 years of age or older as of their date of entry in this promotion in order to qualify. The sweepstakes are subject to federal, state, and local laws and regulations and void where prohibited by law. Orion's employees, its subsidiaries, affiliates, suppliers, partners, contractors, prize suppliers, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of Employees' immediate family and/or those living in the same household of Employees are ineligible to participate in the Sweepstakes. Employees or officials of any government entity are not eligible to participate in the Sweepstakes. 

2. Agreement to Rules. By utilizing any of the Orion Behavioral Finance Tools (“BeFi Tools”) you will automatically be entered into the Sweepstakes. The entrant (“You” or the “Entrant”) agrees to abide by these Terms and Conditions, which are fully and unconditionally binding in all respects. Orion reserves the right to refuse, withdraw, or disqualify any entry at any time at Orion’s sole discretion. By entering these Sweepstakes, You represent and warrant that You are eligible to participate based on the eligibility requirements and criteria set forth under these Terms and Conditions. You also agree to accept the decisions of Orion as final and binding as it relates to the content of the Sweepstakes.

3. Entry Period. The Sweepstakes begins on June 26, 2023 12 AM CST and ends on July 31, 2023 12 PM CST (“Entry Period”). To be eligible for the Sweepstakes, Orion Behavioral Financial Tools must be used within the specified Entry Period.

4. How to Enter; Restrictions; Rules. Eligible Entrants can enter the Sweepstakes utilizing any of the BeFi Tools no later than July 31st, 2023. After using any of the BeFi Tools, You will be automatically entered into the Sweepstakes to win one of the Sweepstakes Prizes (as defined below). You may also enter the Sweepstakes by entering your name and email address at the bottom of this form during the Entry Period. To qualify as a valid entry, your email must include the name of the Sweepstakes, your first and last name, and must be sent from a valid email address. As an Entrant, Your entry must fully meet all Sweepstakes requirements, as specified in these Terms and Conditions, in order to be eligible to win the Prize (defined below). Incomplete entries or those that do not adhere to these Terms and Conditions or specifications will be disqualified at Orion's sole discretion. Orion reserves the right to ask for additional information at any time for purposes of determining entry eligibility or fraud protection. Limit one (1) entry per eligible Entrant during the Entry Period, regardless of method of entry. Persons who attempt to enter the Sweepstakes multiple times will only be granted one (1) entry. Orion reserves the right to cancel the Sweepstakes at any time.

5. Prizes. The five (5) winners of the Sweepstakes (the “Winners”) will receive one of the following one (1) 1-hour virtual client presentation with Dr. Daniel Crosby, (1) 1-hour consult with Dr. Daniel Crosby, and three (3) signed copies of Dr. Crosby’s book (individually, each a “Prize” and together, the “Prizes”). The Prizes shall be determined solely by Orion. There shall be no cash or other prize substitution permitted except at Orion’s sole discretion. The Prizes are non-transferable nor shall the Winners request substitutions or the cash equivalent value of the Prizes. The Winners, upon acceptance of the Prizes, are solely responsible for all expenses related to the Prizes, including without limitation any and all local, state, and federal taxes. By accepting the Prizes, the Winners grant permission for Orion to use the Winners’ likeness, entries, and names for purposes of advertising and trade without further compensation, unless prohibited by law.

6. Odds. The total number of eligible entries received by Orion determines the odds of winning and Orion will select 5 Winners by random drawing.  

7. Selection and Notification of Winner. The Winners will be selected by a random drawing, under the supervision of Orion. Orion will notify the Winners within five days following the selection of the Winners. Orion is not responsible for, nor shall have no liability for, the Winners’ failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall Orion be liable for the Winners’ provision of incorrect or otherwise non-functioning contact information. If the Winners: (i) fail to claim the Prizes within three (3) days from the time the Prizes notification were sent; (ii) are found ineligible; or (iii) do not complete and return an executed declaration and release within the specified timeframe, the Prizes may be forfeited and alternate Winners may be selected. Receipt of the Prizes (offered in the Sweepstakes) by the Winners is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF THE WINNERS VIOLATES ANY OF THESE TERMS AND CONDITIONS, THE WINNERS (AT ORION’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by You. By entering into the Sweepstakes, You understand and agree that Orion, any individual acting on the Orion’s behalf, and the licensees, successors, and assigns of Orion shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, Your submission, name, photo, portrait, voice, likeness, image, statements about the Sweepstakes for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.

9. Additional Terms. In its sole discretion, Orion reserves the right to modify, suspend, cancel, or terminate the Sweepstakes should non-authorized human intervention, a bug or virus, fraud, or other causes beyond Orion’s control, impact or corrupt the security, fairness, proper conduct, or administration of the Sweepstakes. Orion is not responsible for: (i) any lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by You or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Sweepstakes; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to Your or any other computer or device resulting from downloading any materials in connection with the Sweepstakes. Orion, in the event of any of the aforementioned issues, may determine the Winners based on all eligible entries received prior to and/or after (if appropriate) the action taken by Orion. Individuals who tamper with or attempt to tamper with the operation or entry process of the Sweepstakes or website or violate these Terms and Conditions will be disqualified by Orion in its sole discretion. In its sole discretion, Orion has the right to maintain the integrity of the Sweepstakes. Attempts by any Entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. If any such attempt is made, Orion reserves the right to seek damages to the fullest extent permitted by law. By entering the Sweepstakes, you agree to comply with these Terms and Conditions, including all eligibility requirements. All entries will become the property of Orion, unless prohibited by law, and will not be returned. Each entry will constitute an assignment of copyright or other rights associated with the entry to Orion.

10. Limitation of Liability. Your entry into the Sweepstakes constitutes Your agreement to release and hold harmless Orion and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Sweepstakes and/or (i) the Winners accepting, possessing, using, or misusing of the awarded Prizes; (ii) any type of technical failure associated with the Sweepstakes; (iii) the unavailability or inaccessibility of any transmissions via cell phone or by internet service; (iv) unauthorized intervention in any part of the Sweepstakes entry process; (v) electronic error or human error in the Sweepstakes administration or the processing of entries.

11. Governing Law; Disputes. THE SWEEPSTAKES ARE GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF NEBRASKA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. The Entrant agrees, as a condition of participating in the Sweepstakes, that if any disputes cannot be resolved between the Entrant and Orion, and if causes of action arise out of or are connected with the Sweepstakes, they shall be individually resolved exclusively before a court located in the State of Nebraska having jurisdiction, without resorting to any form of class action. Under no circumstances in any such dispute shall the Entrant be permitted to obtain awards for, and hereby waives all rights to punitive, incidental, or consequential damages, including reasonable attorney’s fees.
